Are there any circumstances under which an individual’s Psychiatric Advance Directive (PAD), cannot or should not be followed?

Yes, a PAD would not be followed:

  • If it conflicts with “generally accepted community practice standards.”
  • If it conflicts with applicable law.
  • If it conflicts with emergency treatment.
  • If the treatments requested are not feasible or available.
